Emailyze provides a disposable email detection API and related tools. We classify email domains and addresses as disposable, personal, freemail, masked, or unknown based on our domain database and algorithms. You may use our API to check single or batch emails, subject to your plan limits and these Terms.

3. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You may not:

• Use the services to violate any applicable law, regulation, or third-party rights
• Submit false or misleading information, or impersonate another person or entity
• Attempt to gain unauthorized access to our systems, other users' accounts, or API keys
• Abuse, overload, or disrupt our services, including by circumventing rate limits or security measures
• Use the services for spam, phishing, or other malicious purposes
• Resell or redistribute our services without explicit written permission
• Reverse engineer, decompile, or attempt to extract our domain database or algorithms

We reserve the right to suspend or terminate access for violations of acceptable use.

4. API Usage

API access is subject to your plan and rate limits. You are responsible for securing your API keys and for all activity under your account. You may not share API keys with unauthorized parties. We may change rate limits, pricing, or features with reasonable notice to the extent permitted by your plan.

5. Account Termination

You may terminate your account at any time. We may suspend or terminate your account or access for breach of these Terms, non-payment, or at our discretion with notice. Upon termination, your right to use the services ceases. We may retain data as required by law or our retention policies.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMAILGUARD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD 100), WHICHEVER IS GREATER. OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Indemnification

You agree to indemnify, defend, and hold harmless Emailyze and its affiliates from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the services, your violation of these Terms, or your violation of any third-party rights.

8. Dispute Resolution

Any dispute arising from these Terms or the services shall be resolved by binding arbitration in accordance with the rules of [Insert arbitration body], except that either party may seek injunctive relief in the courts.
